Terms of Service

These Terms of Service apply to your use of the ordering website and SMS services powered by Lexical Systems LLC dba OrderJam ("Platform"). By placing an order, you agree to these terms.

1. The Relationship

OrderJam provides the software to facilitate your transaction. You are purchasing goods directly from the Restaurant, not from OrderJam. The Restaurant is solely responsible for:

• The quality, safety, and preparation of the food.
• The accuracy of menu prices and descriptions.
• Fulfilling the delivery or pickup order.

2. AI Disclaimer (Read Carefully)

Our Platform uses Artificial Intelligence (AI) to assist with SMS orders. AI is not perfect. It may occasionally misunderstand your request (e.g., toppings, quantities).
Your Duty: You must review the Order Confirmation page/text before paying. Once you confirm payment, you acknowledge the order is correct.

3. Accounts & Authentication

To facilitate your order history and reordering convenience, an account is automatically created for you linked to your mobile phone number when you place an order.

• Authentication: You acknowledge that access to your account is authenticated via a one-time link or code sent to your mobile number. Anyone with access to your mobile device or these links may be able to access your order history.
• Security: You are responsible for keeping your device secure. OrderJam is not liable for unauthorized orders placed if your phone or SMS links are accessed by others.

4. Refunds & Cancellations

Because OrderJam immediately transfers your payment to the Restaurant, OrderJam cannot issue refunds directly.

• All refund requests must be directed to the Restaurant.
• The Restaurant has sole discretion over accepting cancellations once food preparation has begun.

6. Payment Authorization

You authorize us (via Stripe) to charge your payment method for the total amount displayed at checkout, including taxes, tips, and fees. If a charge is declined, your order will not be sent to the kitchen.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ORDERJAM IS NOT LIABLE FOR ANY INJURY, ILLNESS (FOOD POISONING), OR DAMAGES ARISING FROM THE FOOD OR SERVICES PROVIDED BY THE RESTAURANT. OUR LIABILITY IS LIMITED SOLELY TO THE TRANSMISSION OF THE ORDER DATA.

8. SMS/Mobile Messaging Program

By texting us or entering your phone number at checkout, you agree to receive transactional and promotional updates from the OrderJam platform regarding your order status.

• Cancellation: Reply STOP to cancel at any time. You will receive a one-time opt-out confirmation text.
• Help: Reply HELP for assistance.
• Cost: Message and data rates may apply.
• Frequency: Message frequency varies based on your ordering activity.
• Liability: Carriers are not liable for delayed or undelivered messages.
